Terms of Service

By accessing or using AuricleDrift ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

These terms apply to all visitors, users, and others who access or use the Service. We reserve the right to update these terms at any time, with notice provided as described in Section 11.

AuricleDrift is a wellness application that generates binaural beat frequencies and solfeggio tones using the Web Audio API. It is intended for relaxation, meditation, and personal wellness purposes.

AuricleDrift is NOT a medical device. It does not diagnose, treat, cure, or prevent any medical condition. Nothing in the Service constitutes medical advice. Always consult a qualified healthcare professional before making changes to your health regimen.

You must be at least 18 years of age to create an account. By creating an account, you represent that you are 18 or older.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to terminate accounts at our discretion, including for violations of these terms.

AuricleDrift offers free and paid subscription tiers. Paid subscriptions (Drift at $4.99/month and Drift Pro at $9.99/month) are billed monthly through Stripe.

Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through your Stripe billing portal; access to paid features continues until the end of the current billing period.

We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us within 30 days and we will investigate.

We reserve the right to change pricing with 30 days' notice to active subscribers.

You agree not to: - Use the Service for any unlawful purpose - Attempt to reverse-engineer, decompile, or extract the source code of the Service - Use automated tools to scrape, crawl, or systematically download content - Resell or redistribute access to the Service - Use the Service in a way that could damage, disable, or impair it - Attempt to gain unauthorized access to any part of the Service

The binaural beat and frequency content generated by the Service is for your personal, non-commercial use only.

Binaural beats and sound therapy are not recommended for: - Individuals with epilepsy or seizure disorders - People with pacemakers or other implanted electronic medical devices - Pregnant women (due to insufficient safety data) - Children under 18 - Individuals who are operating heavy machinery or vehicles

Do not use AuricleDrift at a volume level that causes discomfort. Extended listening at high volumes can contribute to hearing fatigue. We recommend low-to-moderate volume for all sessions.

If you experience dizziness, discomfort, or unusual symptoms during use, discontinue use and consult a healthcare professional.

The Service, including all code, design, visual assets, and written content, is the intellectual property of AuricleDrift and its developers. All rights reserved.

The sacred geometry visualizer, the frequency synthesis engine, the daily manifestation content, and the session content are proprietary to AuricleDrift.

You may not copy, reproduce, distribute, or create derivative works based on the Service without our written permission.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that: - The Service will be uninterrupted or error-free - Any specific health or wellness outcome will be achieved - The frequency content will be effective for your particular condition or goal

To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, AuricleDrift and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages.

Our total liability to you for any claims arising from these terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property claims.

We may update these terms periodically. For material changes, we will notify active subscribers via email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated terms.
